Nothing in these Terms and Conditions shall be construed to exclude or limit any rights you may have as a consumer to the extent that such liability and rights may not be excluded or limited under applicable statute or law.
All information contained in our sales literature or correspondence is provided for guidance only and does not form part of this contract, unless we agree otherwise with you in writing. None of our representatives, agents or sales persons has authority to vary, amend or waive any of these terms on our behalf and no amendment or addition to any of these terms shall be deemed to have been accepted unless we agree otherwise with you in writing.

description of goods and services
Descriptions of the goods are set out on our website. Whilst we will attempt to ensure that there are no changes to the goods to be supplied, it is possible that there might be some minor variations to the description and/or specification of the goods which arise by virtue of changes made by the manufacturers of the parts supplied which form part of the goods.
Please note that all eye-spec glasses are non prescription.
If you are unsure of the relevant strength to be applied to the goods, please visit your optician for guidance, alternatively refer to our on screen sight test - this is purely an indication and guide for the lens strength required.
All our reading glasses are to be used for reading and near vision. They should not be used for long distance vision or driving.
ordering
All orders for goods shall be deemed to be an offer by the customer to purchase goods pursuant to these Terms and Conditions and are subject to acceptance by eye-spec. eye-spec may choose not to accept an order for any reason.
Where the goods ordered by the customer are not available from stock the customer shall be notified and given the option to either wait until the goods are available from stock or cancel the order and receive a full refund.
No binding contract will exist between us until we have accepted your order.
delivery
Unless agreed otherwise in writing:
Delivery of the goods will take place at the delivery address stated on the order form.
If your order is placed on a working day before noon, it will be dispatched the same day. Orders placed on the weekend or on a bank holiday will be dispatched on the next working day.
Any dates specified by us for delivery of goods are intended to be an estimate and time for delivery is not guaranteed. If no dates are specified, we will endeavour to deliver within a reasonable time.
If for any reason (not due to our fault) you do not accept delivery of any of the goods in accordance with this paragraph then we may charge you an additional fee to cover any reasonable additional direct costs incurred by us as a result including additional insurance, delivery, storage or similar charges.
inspection of goods
Upon receipt of the goods you should carefully inspect them. If any of the goods are damaged, lost or not what you ordered please contact us to inform us of the problem and do not use the goods.
price of goods & payment
The price for the goods will be the price stated on our website.
The price for the goods includes any VAT payable.
Unless we agree otherwise in writing, you must pay to us the price for the goods when placing your order.
refund & cancellation policy
If the goods are damaged or faulty they should be returned by the customer within 21 days with a copy of your invoice (sent by email). The customer will receive a full refund for the monies paid for the goods. You have the right, in addition to your other rights, to cancel the contract and receive a refund by informing eye-spec in writing within 7 working days of receipt of the goods. All returned products must be in their original condition along with a proof of purchase.
We can only accept goods bought via www.eye-spec.com
returning value sets
If you purchase a “value set” we can only accept and process returns for the complete set.
ownership and responsibility of goods
You will be liable for any loss or damage to the goods from the time of delivery unless such loss or damage is demonstrably caused by our negligence.
resale of goods
You are not allowed to resell eye-spec products to the public.
personal information
Your submission of personal information through the store is governed by our privacy policy.
limitation of our liability to you
If products we deliver to you are not as ordered or are damaged, defective or of incorrect quantity you should contact us within 21 days of purchase. We will replace the incorrect, damaged or defective products or make good the shortfall in quantity or, at our option, credit the price and delivery charges of those products to you. If you do not receive products ordered you should notify us within 7 days from the last day of your estimated delivery range. If you inform us after this date, we do not accept any liability for non-delivery.
We will deliver the products ordered or, at our option, credit the price and delivery charges of the non-delivered products to you, or if we have not accepted your order and have been unable to contact you, we will notify you of the reason for non-acceptance.
To the extent permitted by law, eye-spec accepts no liability for loss, damage or injury arising as a consequence of non delivery of goods or advice provided.
eye-spec shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if eye-spec has been advised of the possibility of such damages.
With Rest of The World shipments, you are liable for any taxes and duties imposed by your local taxation authority (e.g. customs duty, excise duty and/or import VAT). It is important that you check these rates before ordering.

We will endeavour to honour our responsibilities under this contract within a reasonable time frame unless it is impossible because of circumstances outside of our control.
user comments, feedback and other submissions

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

This contract is personal to you. Nobody other than you will be able to benefit from this contract. You may not transfer your rights or the benefit of any of the provisions of this contract to any other person without our prior written permission.
